Terms & Conditions – Usage Rules
Rechtliche Grundlagen und Nutzungsbedingungen für die Dienste von CVwerk.
1. Scope
These terms apply to your use of the CVwerk website and of the premium PDF export. By using the service you accept these terms. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law. You must be at least 18 years old to purchase the premium service; if you are under 18 you may use the free service only with the consent of a parent or guardian.
2. Description of the service
CVwerk offers an online service for creating professional CVs. The platform enables users to:
- Create and edit CVs online
- Use various professional designs
- View a preview of the CV
- Save created CVs in their account
Basic access (creating, editing, saving and previewing) is provided free of charge. The ad-free download of the CV as a PDF without a watermark is a paid premium service (see section 5).
3. Registration, account and eligibility
Registration is required to use the service and to purchase the premium export. Truthful information must be provided during registration, and you must keep your login credentials confidential and protect them from access by third parties. You must be at least 18 years old to purchase the premium service; if you are under 18 you may use the free service only with the consent of a parent or guardian.
The user has no claim to a specific username. We reserve the right to refuse registrations without giving reasons.
4. Premium service and conclusion of contract
The ad-free PDF download without a watermark is offered as "CVwerk Premium". This is a one-time payment – there is no subscription and no recurring charge.
The paid contract is concluded when the user submits the order during the checkout process by clicking the "order with obligation to pay" button (or "Unlock now") and the payment is successfully completed. A registered user account is required, as the premium entitlement is assigned to the account.
After successful payment, the premium feature is automatically and permanently (lifetime) unlocked for the user account.
5. Prices and payment
The price of CVwerk Australia Premium is a one-time payment of €7.99, displayed as a single total price inclusive of tax before the order is completed; there is no subscription and no recurring charge.
Sales and payment processing are handled by our reseller Freemius, Inc. (4023 Kennett Pike, Wilmington, DE 19807, USA). Freemius acts as the Merchant of Record (reseller) and handles the processing of the payment, the invoicing, as well as the calculation and remittance of VAT. In this respect, the terms and conditions of Freemius apply additionally (freemius.com).
Depending on availability, common credit and debit cards as well as other payment methods offered by Freemius are accepted as means of payment. The invoice is provided to the user by Freemius via email after the purchase.
6. Refunds and consumer guarantees
Australia has no change-of-mind refund right for digital purchases. If the service fails to meet an Australian Consumer Law consumer guarantee – due care and skill, fitness for a purpose you made known, or supply within a reasonable time where no time was agreed – you are entitled to a remedy: for a major failure, cancellation and a refund (or a price reduction); for a minor failure, we may remedy the problem first and, if we cannot, you may have it remedied elsewhere at our cost or cancel for a refund. These rights cannot be excluded.
How to raise a claim and how we assess major and minor failures is set out in our refund policy.
7. Acceptable use
The user undertakes:
- To use the platform only for lawful purposes
- Not to create any abusive or fraudulent content
- Not to infringe the rights of third parties
- Not to use any automated systems for the mass creation of CVs
8. Content and intellectual property
The CVs created by the user remain the property of the user. CVwerk makes no ownership claims to the content of users.
The designs, templates and other content provided on the website are protected by copyright and may only be used within the scope of using CVwerk.
9. Data protection
We handle personal data as described in our privacy policy and in accordance with the Australian Privacy Principles in the Privacy Act 1988. You may ask for access to your personal information and for its correction, and you may complain to the Office of the Australian Information Commissioner (OAIC).
10. Limitation of liability
We accept no liability for:
- The constant availability of the website
- The error-free nature of the created documents
- The success of an application using the created CVs
Nothing in this clause excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, and no term of these terms limits your right to bring proceedings. The user is responsible for checking the created CV for accuracy and completeness before use.
11. Termination and deletion
The user can delete their account at any time without giving reasons. We reserve the right to suspend or delete accounts without prior notice in the event of breaches of these Terms and Conditions.
12. Changes to these terms
We may update these terms for future use of the service. Changes do not affect orders that have already been completed, and where the law requires your consent we will ask for it. Registered users will be informed of material changes by email.
13. Governing law and final provisions
These terms are governed by the law of the Federal Republic of Germany, except that nothing in them excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law. Should a provision be invalid or unfair, the remaining provisions stay in force.
